The Allahabad High Court has granted bail to a person accused of raping a postgraduate student, saying that the survivor "herself invited trouble" and bore responsibility for the incident. The accused, who was arrested in December 2024 for allegedly raping the woman in Delhi, said the act was consensual.
"This court is of the view that even if the allegation of the victim is accepted as true, then it can also be concluded that she herself invited trouble and was also responsible for the same," Justice Sanjay Kumar Singh said.
The court said, although her medical examination revealed a torn hymen, the doctor did not provide any conclusive opinion regarding sexual assault.
