Supreme Court rejects plea of Gautam Gambhir foundation in Covid drug hoarding case

The Supreme Court on Monday refused to stay the proceedings against BJP MP Gautam Gambhir's foundation in Covid-19 drugs hoarding case. The Gautam Gambhir Foundation had moved the top court seeking a stay on prosecution under Drugs and Cosmetics Act.

The Supreme Court on Monday refused to stay the proceedings against BJP MP Gautam Gambhir's foundation in a case relating to alleged hoarding and distribution of Covid-19 medicines.

A bench comprising Justices DY Chandrachud and MR Shah said at a time when people were running helter skelter for medicines and drugs, one foundation buying large amounts of medicine "was not done".

“We do not want to say anything but we also have our ears to the ground,” the bench observed, asking the petitioner to approach the Delhi High Court and seek appropriate remedy.

The Gautam Gambhir Foundation had moved the Supreme Court seeking a stay on the prosecution under the Drugs and Cosmetics Act. Senior advocate Kailash Vasdev, appearing for the foundation, later withdrew the petition.

Earlier, the Aam Aadmi Party government in Delhi had informed the Delhi High Court that Gautam Gambhir Foundation has been found guilty of unauthorisedly stocking, procuring and distributing the Fabiflu medicine to Covid-19 patients.

AAP MLA Praveen Kumar has also been found guilty of similar offences under the Drugs and Cosmetics Act, the court was informed.
