2008 Aarushi Talwar murder case highlights: Talwars may be freed from Dasna jail tomorrow

Aarushi Talwar murder case verdict highlights: Allahabad High Court on Thursday acquitted Rajesh and Nupur Talwar in the double murder case of their 14-year-old daughter, Aarushi Talwar and domestic help Hemraj.

The Allahabad High Court acquitted the Talwar couple in the double murder case of their 14-year-old daughter, Aarushi Talwar and domestic help Hemraj. Nupur and Rajesh Talwar, were serving life imprisonment in Ghaziabad’s Dasna jail, a sentence awarded to the parents four years ago by a CBI court. Challenging their conviction following the CBI court order, the couple had filed an appeal in Allahabad High Court.

On May 16, 2008, Aarushi Talwar was found murdered in her bedroom at the family’s residence in Noida’s Jal Vayu Vihar. Her throat was slit and her head bludgeoned. The police initially suspected their domestic help, Hemraj, but a day later his body too was recovered from the terrace of the same flat.

7.38 pm: Reacting to the verdict, former CBI director AP Singh said, “Only weakness we found was that scene of crime had been badly tampered on the first day itself. As a result, after that we got nothing of value from the scene of crime. That was the major lacuna in the entire investigation.”

5.38 pm: Evidence insufficient to prosecute Rajesh and Nupur Talwar. Court has only said what I had said in the beginning: Former CBI Director AP Singh, was quoted as saying by ANI.

5.33 pm: Lawyer Rebecca John, who was part of Talwars’ legal team, said she was relieved by the judgement. She claimed the whole case was based on “innuendos” and would “not have carried through”, reported PTI.

5.31 pm: “We have restored honour to the teenager and the help and established Aarushi’s parents were not guilty. The four were subject to intense character assassination, especially by the media. We argued and established that there was a possibility of outsiders having entered the house and committing the crimes, unlike the prosecution’s hypothesis that the parents were the only two other people in the house that was locked from the inside,” Talwars’ counsel Tanveer Mir said to The Indian Express.

4.44 pm: “I am grateful to judiciary. I have seen them suffering all these years. It has been really testing. I am emotionally drained,” B.G Chitnis, Nupur Talwar’s father said.

4.37 pm: “Deeply grateful to God. It has been a tiring and exhausting long 10 years journey. I am grateful to Allahabad HC for acquitting Rajesh and Nupur. I would also like to extended thanks to reporters, lawyers and people who have supported us through the journey,” Vandana Talwar, Aarushi’s aunt said in an interaction with media.

4.30 pm: Vishal Bharadwaj who was the producer of Talvar, in an official statement said, We were questioned by a lot of people when we made Talvar even though we didn’t take any sides in presenting the story and maintained as neutral a viewpoint as possible. I am overwhelmed and relieved to hear of the Talwars’ acquittal and this strengthens my faith in the Indian judicial system. However, it still pains me when I think about the precious years lost in prison and the emotional trauma that the parents had to go through, so much so that they couldn’t even mourn their own daughter’s demise.”

4.26 pm: Meghna Gulzar, director of Talvar movie, welcoming the verdict said, “I feel extreme relief and gratitude. Truth has prevailed. The loss is irreparable but I am happy that truth prevailed.” The film looked at the multiple investigation theories behind Aarushi Talwar and Hemraj’s murder in Noida.

4.10 pm: Aarushi Talwar was found murdered in the bedroom of her house in Jalvayu Vihar, Noida.

3.55 pm:

3.45 pm: Both Rajesh and Nupur Talwar have been acquitted and we are expecting that they will be out of jail tomorrow, said Talwars’ lawyer.

3.37 pm: Rajesh & Nupur Talwar are happy, and said that they have got justice, DR Maurya, Jailor, Dasna Jail was quoted as saying by ANI. The couple were serving lodged in Dasna jail after the CBI court convicted them with life imprisonment.

3.28 pm: Omar Abdullah, taking to Twitter, welcomed the verdict. “The law presumes innocence until guilt is established beyond reasonable doubt. Innocent till proven guilty is bedrock of criminal law,” he said.

3.18 pm: The CBI is waiting for the judgment copy and will decide the next course of action after studying it, reports ANI

3.00 pm: Allahabad High Court was of the view that as per circumstances and evidence on record they can’t be held guilty. The Talwar couple has been given benefit of doubt.

2:55 pm: Rajesh, Nupur Talwar acquitted by Allahabad High Court.

2: 40 pm: Both the judges have arrived in the court room.  The verdict can be expected any minute now.   

2:30 pm: The verdict is expected to be delivered at 2:45 pm.  Challenging their conviction in the murder of their daughter, the dentist couple had filed an appeal in Allahabad High Court. The court on September 7 had reserved its judgement and had fixed October 12 as the date for the verdict.

1: 50 pm: Following a movie and a book made on the investigations conducted by CBI and UP police on the Aarushi Talwar murder case, which portrays the convicted parents as innocent, the CBI in response had uploaded the entire court proceedings and orders related to the case on its website. The, then CBI spokesperson Devpreet Singh said, “The Aarushi-Hemraj murder case is being discussed in public domain. To facilitate the general public, CBI has put all important court orders on its website cbi.nic.in.”

12: 45 pm: In the book, author Avirook Sen writes, “”Nupur Talwar had annoyed Kaul because she wasn’t intimidated by him in person. So he came up with his own little psy-ops project. He created a special e-mail address in order to communicate with Rajesh and Nupur Talwar: ‘hemraj. jalvayuvihar@gmail.com’, under the user-name ‘Hemraj Singh’…Rajesh Talwar would receive e-mailed summons from this address. When he was asked for his consent to undergo narco-analysis, for instance, ‘Hemraj Singh’ wrote him a mail on the CBI’s behalf.”

12:15 pm: A book on Aarushi Talwar murder probe was written by Avirook Sen. In the book the author targets the shoddy and insensitive investigation by UP police and the CBI. He also believed that the conviction was a premeditated judgment.

12:00 pm: The Allahabad High Court is expected to announce the verdict after 2:30 pm.   

11:30 am: Dr Sunil Mohre, who conducted Aarushi’s post-mortem on May 16, 2008, spoke in the court in July 2012 of a “prominent opening” of her private parts. However, this was missing in the report prepared by the doctor who wrote ““NAD (no abnormality detected)” in the section on the teenager’s private parts.  

11:15 am: The identity of the person who responded to the phone call made by Nupur Talwar in the morning still remains a mystery.

11: 00 am: Even after considering the fact that the murder was carried out with ‘surgical precision’, no dental equipment such as the scalpel were seized by the CBI.    

10:50 am: The Talwars were convicted guilty on November 25, 2013. CBI judge Shyam Lal held the parents guilty for both the murders and destruction of evidence. “The parents are the best protector of their own children and that is the order of the human nature, but they have been freaks in the history of mankind when the father and mother became the killer of their own progeny,” wrote the judge.

10: 10 am: As the case drew prominence, the then Chief Minister Mayawati handed it over to CBI. During the CBI investigation, narco-analysis tests were conducted on the parents. However, in December, 2010, CBI submitted a closure report to the court on the grounds of ‘insufficient evidence’, giving a clean chit to all the servants and citing Rajesh Talwar as the prime suspect.

9:30 am: Six days after the murder, police suspected it to be a case of honour killing and both Rajesh, Nupur Talwar came under the scanner. The police alleged that Rajesh carried out the murder after finding his daughter and Hemraj in an ‘objectionable’ position. However, no forensic or material evidence was given by the police to substantiate the claim. Rajesh Talwar on May 23, 2008 was arrested for the double murder.

9: 10 am: The Allahabad High Court on August 29 had granted Nupur Talwar a parole for three weeks to visit her ailing mother. In her plea, she had requested for a parole saying her mother was seriously ill and all her siblings were abroad.

9:00 am: A day after the conviction, the couple were awarded life imprisonment by a special CBI court in Ghaziabad on November 26, 2013.

8:45 am: A division bench of the Allahabad HC had reserved its judgement on September 7 and fixed October 12 as the date to announce its verdict. The bench comprised of justices B K Narayana and A K Mishra.

8:30 am: The Allahabad High Court on an appeal filed by the Talwar couple is likely to announce its verdict today on the murder of fourteen year old Aarushi Talwar. Follow for the latest updates
