On Tuesday, the US Supreme Court seemed unsure about restricting access to the abortion pill called mifepristone. Reports say the court suggested it probably won’t support such restrictions and questioned whether it’s right to challenge the drug’s federal approval.

The case is about choices made by the US Food and Drug Administration (FDA) to make it easier to use mifepristone since 2016. Some anti-abortion groups and doctors, like the Alliance for Hippocratic Medicine, a group of doctors and activists against abortion, are questioning the safety of the drug.

In November 2022, they filed a lawsuit saying that mifepristone, which the FDA first approved in 2000, is not safe and that the FDA wrongly made it more accessible.

Even though many studies have shown that mifepristone is safe, the group argued that their members might be harmed by treating patients who use the drug. According to the BBC, they also said that doing so would go against their religious beliefs.

The US Solicitor General, Elizabeth Prelogar, said that the doctors didn’t prove they were directly harmed by the FDA’s decisions. She warned that if the court sided with the anti-abortion group, it could mess up how drugs are approved federally and seriously hurt women all over the country.

What’s interesting is that some justices, even those who usually support anti-abortion arguments, were doubting if the case had strong grounds.

Justice Amy Coney Barrett, who was appointed by Donald Trump, asked the group’s lawyers if the doctors mentioned in the case were forced to perform abortions against their wishes.

Justice Neil Gorsuch, another conservative judge, worried that the case might let a few people turn a small lawsuit into a big deal affecting nationwide rules by the FDA or other government actions.

On the other hand, liberal justices like Elena Kagan and Ketanji Brown Jackson wondered why doctors weren’t protected by their right to refuse based on their conscience.

With both conservative and liberal justices raising doubts, the outcome of this case remains uncertain, but it highlights the ongoing debate surrounding abortion rights in the United States.
